This position has a key role in the agency's mandatory reporting to the Governor's Office of Small, Minority, and Woman Business Affairs (GOSBA) and the Board of Public Works (BPW).
This position supervises the MBE/VSBE Compliance staff within the of the Procurement Policy, Compliance and Reporting (PPCR) Bureau of the Department of General Services (DGS) Office of State Procurement (OSP).
This position serves as the MBE, VSBE and SBR Liaison for DGS and provides expert advice on all MBE, VSBE and SBR support for both DGS OSP and Executive Branch Agencies under DGS OSP's control and oversight, including overseeing the Procurement Review Group (PRG); provides mentoring and training of MBE/VSBE/SBR programs and best practices to the DGS staff and external parties, as needed; tracks all DGS contracts for compliance to all MBE/VSBE/SBR programs; and establishes and maintains supplier relationships by serving as a single point of contact for contractual matters.
POSITION DUTIES Duties for this position include but are not limited to:
Assigns participation goal setting requests to the MBE/VSBE Compliance Unit staff to conduct research to determine validity of suggested goals and make recommendations for the Procurement Review Group (PRG) meetings and other documentation to assist with SBR, MBE and VSBE participation goals in all DGS solicitations and Executive Branch Agencies within DGS OSP's delegated authority to support State requirements.
Assigns to the MBE/VSBE Compliance Unit staff or attends Pre-Bid/Proposal Conferences when MBE and/or VSBE participation goals are established in the procurements to advise vendors on their responsibilities when submitting bids/proposals.
Assigns to the MBE/VSBE Compliance Unit Staff and reviews MBE and VSBE Forms and Waiver Requests and makes recommendations to the DGS OSP Procurement Officers.
Supervises the MBE/VSBE Compliance staff to monitor and track assigned DGS OSP or Statewide contracts for monthly MBE and VSBE subcontractor compliance reporting.
Receives monthly MBE and VSBE reports from the prime contractors and subcontractors for contract tracking.
Maintains a working relationship with MBEs and VSBEs to ensure prime contractor is meeting contractual obligations and requirements with identified subcontractors.
Utilizes the State's Advanced Purchasing and Inventory System (ADPICS) portion of the Financial Management Information System (FMIS) and eMaryland Marketplace Advantage (eMMA) to complete Blanket Purchase Order (BPO) entries to input the MBE and VSBE subcontractors, and participation percentages, where applicable, and following up with monthly data/payment entry to monitor the MBE and VSBE compliance/goal achievement.
Assists the contract monitor and procurement officer with issues of MBE and VSBE non-compliance with State laws, regulations, policies, or procedures and provides guidance regarding required corrective actions.
Supervises MBE/VSBE Compliance staff to assist and train DGS OSP Procurement Officers on reading and interpreting the overall content and information provided in required bid/proposal submission documentation for MBE and VSBE commitments or waiver requests to ensure State procurement statutes, regulations, policies, and procedures are met to make determinations of responsive bids or reasonably susceptible proposals.
Advises DGS OSP Procurement Officers and Procurement Managers on questionable content to confirm documentation is acceptable and meets procurement requirements or if errors or omissions are curable.
Reviews waiver requests to confirm bidders/offerors made a good faith effort in trying to meet MBE and VSBE participation goals established in the solicitations and advises the DGS OSP Procurement Officers in making a determination to accept or deny the waiver request.
Provides training regarding SBR, MBE and VSBE compliance programs to DGS OSP staff, Executive Branch Agencies Senior Procurement Advisory Group (SPAG) meetings , and vendors.
Assists and trains vendors and Procurement Officers on how to complete required MBE and VSBE documentation to respond to Invitations for Bids and Requests for Proposals.
Interfaces directly with senior leadership of DGS, DGS OSP, GOSBA and other Executive Branch Agencies to provide expert advice on SBR, MBE and VSBE programs, institute oversight policies with respect to such programs, and report on the status of specific and/or Statewide compliance and strategic initiatives.
Reviews and provides SBR, MBE and VSBE reports to GOSBA or to other State Agencies as required by legislation.
Reviews and approves SBR, MBE and VSBE monthly and annual statistical reports to ensure accuracy and sufficiency of data; makes recommendations for opportunities to enhance participation from prime contractors to increase the SBR, MBE and VSBE programs Special Projects as assigned by the Director of the Procurement Policy, Compliance and Reporting Bureau or other DGS OSP Senior Management - Chief Procurement Officer (CPO) or Deputy CPO.
MINIMUM QUALIFICATIONS Applicants must meet all minimum (and selective) qualifications to be considered, and to appear on the list of people eligible for hire.

Education:
Bachelor's degree in Business Administration from an accredited college or university.
Experience:
Five or more years of experience with a Supplier Diversity Program (MBE/VSBE/SBR) that includes goal settings, compliance, reporting and outreach, including at least three years of experience supervising resources for the program.
